22 anos depois
Com a presidente Dilma Rousseff, na Rússia, o vice-presidente Michel Temer, em Portugal e o presidente da Câmara, Marco Maia, no Panamá, o presidente do Senado, José Sarney (PMDB-AP), o terceiro na linha sucessória, assumiu na madrugada dessa quinta-feira a presidência da República após 22 anos do final do seu mandato presidencial (1985 a 1990).
Sarney é o presidente em exercício do Brasil até domingo, 16, quando a presidente Dilma retorna ao Brasil.
Sarney nunca foi presidente. Foi usurpador do mandato do Tancredo. Morto Tancredo antes mesmo de assumir, tinham que ser convocadas novas eleições. Era o que dizia a Constituição da época. Aí, os graúdões do PMDB, Ulysses à frente, inventaram essa sacanagem de empossar o vice, que era do PFL. E, depois, deram-lhe ainda mais um ano de mandato, e foi por isso ele passou para o PMDB. Sarney, portanto, nunca foi eleito presidente do Brasil. Deveria estar fora da Galeria dos ex-Presidentes. Aliás, Sarney só é Senador porque a Justiça Eleitoral engoliu essa farsa de que ele tem domicílio no Amapá. E nem me venham dizer que domicílio civil é uma coisa e domicílio eleitoral é outra. Eu sei muito bem a diferença, mas nada me convence que Sarney tenha realmente alguma coisa a ver com o Amapá e não com o seu queridinho Maranhão, em favor do qual ele sempre prejudicou o Pará. E ainda tem gente que aplaude.

E mais: o culpado-mor dessa descarada usurpação do poder foi o Ulysses Guimarães, do PMDB. Foi dele a idéia de engabelar Deus e o mundo com a desculpa de que os militares poderiam aproveitar a ocasião e ficar mais algum tempo no Planalto, e, assim, contra o expresso na Constituição (já nessa época tinha gente que "lia" a Carta Magna do jeito que melhor consultasse aos seus interesses), e "empossaram" o vice. Releiam tudo o que já foi publicado sobre os bastidores da política dessa época e tirem lá suas conclusões, como eu já tirei as minhas. Isso é História. Mesmo o povo tendo memória curta, os fatos históricos não podem ser simplesmente apagados como quer a "estória oficial". Por isso que estão surgindo esses Guias Politicamente Incorretos da História, contando os fatos como os fatos foram. Boas leituras.

A sua tese de usurpação só encontra guarida se olharmos a posse ainda sob a ótica da ditatura militar, aí, todos os presidente do regime foram usurpadores, e Sarney foi o último deles.
Sob o ponto de vista constitucional, Sarney assumiu sob a égide da Carta de 1967 (a Carta Militar) que lavrava, de forma inequívoca, que o vice-presidente eleito no Colégio Eleitoral tomaria posse na morte ou renúncia do titular.
O que Ulisses e Tancredo, desde o hospital onde estava internado, fizeram, foi garantir, com o então presidente Figueiredo, que a Carta Militar seria obedecida e Sarney tomaria posse sem Tancredo (havia uma articulação dos arenistas para empossar o presidente da Câmara Federal, alinhado com os militares). Figueiredo garantiu a Tancredo, por telefone, que garantiria a posse de Sarney, como mandava a Carta, mas não iria passar a faixa, pois era desafeto de Sarney.
Com a Carta de 1988 (Foi Sarney quem convocou a Assembleia Constituinte), em casos similares em eleições municipais (morte ou renúncia de titular eleito, antes da posse) surgiram interpretações diversas o que causou conflito de jurisprudência, pois a nova Carta não era clara sobre o assunto.
Isso causou o envio ao Congresso, pelo então presidente Sarney, de uma legislação complementar que dirimisse o assunto. O diploma legal, aprovado pelo Congresso Nacional, veio a ser a Lei 7.773/89, que dirime qualquer dúvida a respeito, ao declarar que a chapa de titular e vice é indivisível.
Portanto, do ponto de vista legal, tanto a jurisprudência emanada da Carta de 67 quanto sob o império da Carta de 1988, o vice toma posse caso o titular morra ou renuncie antes da posse. A ocorrência de novas eleições é regulamentada em outro diploma e se dá em determinado período de tempo restante para o final de mandato, em caso de vacância do titular já empossado.
Dois casos similares ocorreram no Pará, no pleito passado, com a morte dos titulares ainda em dezembro, antes da posse: os vices tomaram posse como titulares e, nesse, caso, o 2º na linha sucessória é o presidente da Câmara Municipal.
Quanto a sua aversão pessoal a Sarney, Ulisses e etc., é um direito seu e você não é o único, todavia, permita-me observar que não é razoável argumentar aversões distorcendo a história e fundamentando razões que não correspondem aos fatos.
QUEM DERA os militares ainda estivessem no poder! Ao invés disso, temos que engolir esse Lulo Petismo que elevou a corrupção a níveis jamais imaginados por qualquer homem desde os tempos mais remotos!!!
